Escaped convict was using cane and beret as disguise

Kenneth Conley was last seen by authorities making a daring escape down the side of a high-rise federal jail under the cover of night.


Friday afternoon, he was found hobbling down a Palos Hills street with a cane, one part of a flimsy disguise that included a bulky overcoat and a beret pulled low over his face.


An 18-day manhunt for the escaped bank robber ended after a maintenance employee working at a residential building in the southwest suburb called 911 about a suspicious man.








Conley, as it turns out, had not gone very far from places he used to live and homes where friends and family still reside.


But law enforcement sources said Friday that he apparently had no help — the former strip club employee was sleeping in the building's basement.


Conley was scheduled to appear in federal court at 10:30 a.m. Saturday.


The spectacular jailbreak — the first at the Metropolitan Correctional Center in almost 30 years — embarrassed federal authorities and seemed to be meticulously planned. Conley and Joseph "Jose" Banks rappelled to freedom using a rope fashioned from bedsheets. But like Banks, who was arrested two days after the escape in the North Side neighborhood where he was raised, Conley had no apparent plan for life on the run and was found holed up in an area where he had known ties.


Palos Hills police said a maintenance worker at a building in the 10200 block of South 86th Terrace called police about 3:30 p.m. to report the "suspicious person" who might be sleeping at the premises. Officers arrived to find a man walking down the street in an overcoat and pretending to use a cane. He appeared to be trying to look older than his actual age, police said.


"Our officers stopped to talk to him and he said he was just visiting," Deputy Chief James Boie told the Tribune. "He gave them a phony name, and while they're trying to run the information, he got wise that they were going to figure it out, and he pushed one of the officers down and took off running."


Boie said two additional officers responding to the scene caught Conley about a block away as he was trying to force his way into the Scenic Tree apartment complex, which is across the street from the police headquarters. He was wrestled down but did not offer any other resistance. Conley and one officer were taken to Palos Community Hospital for observation, he said.


Police found a BB pistol in Conley's pocket. He had no cash or other weapons, Boie said.


Residents in the sprawling, low-rise apartment complex where Conley was apprehended said they had seen a lot of police activity in the area earlier in the day, including K-9 units.


Chris Stevens, who has lived in the complex for a decade, said FBI agents knocked on her door at about 7 a.m., showed her a photo of Conley and asked if she had seen him. The agents told her he had been spotted in the area.


By the afternoon, Stagg High School junior David Griffith, 16, said he was with a friend taking out the garbage at the complex when he heard shouting and saw an officer run past him into a grassy area behind his building.


"We ran back in my house, opened the patio door, looked in the back and just saw a whole bunch of police officers just tackle (Conley)," Griffith said. "It was crazy. Nothing ever happens over here."


According to court records, Conley once lived in an apartment near the scene of his arrest. Boie said Conley was known to Palos Hills police because he'd had multiple resisting and obstructing arrests in 2004. Even still, they were surprised when they realized whom they had just arrested.


"I'm sure they were a little surprised that they had the guy standing in front of them,'' Boie said.


A law enforcement source told the Tribune that U.S. marshals and FBI agents met this week to discuss the hunt for Conley and went to Palos Hills on Friday morning to canvass specific addresses where he had ties. Some of the doors they knocked on were in the same block where Conley was found later in the day, the source said.


Conley, 38, was awaiting sentencing for a single bank holdup when authorities said he and Banks removed a cinder block from their cell wall and scaled down about 15 stories of the sheer wall of the jail early on Dec. 18. The cellmates were last accounted for during a routine bed check, authorities said. About 7 a.m. the next day, jail employees arriving for work saw the bedsheets dangling from a hole in the wall down the south side of the facade.


The FBI said a surveillance camera a few blocks from the jail showed the two wearing light-colored clothing hailing a taxi at Congress Parkway and Michigan Avenue about 2:40 a.m. They also appeared to be wearing backpacks, according to the FBI.

A+E Networks and Amazon Prime Reach Licensing Deal






LOS ANGELES (TheWrap.com) – “Pawn Stars” fans, rejoice; you’ll now be able to catch Big Hoss and Chumley on Amazon Prime.


Amazon announced Friday that it has struck a licensing deal with A+E Networks to carry A&E, bio, History and Lifetime programs on its premium Prime Instant Video service. The deal includes prior seasons of programs such as “Pawn Stars,” “Storage Wars” and “Dance Moms.”






Amazon Prime, which allows subscribers to stream videos through a variety of gadgets, costs $ 79 a year.


The pact between Amazon and A+E Networks comes a few months after rival streaming service Netflix decided to drop all but about 300 hours of A+E programming. Netflix, which had been seeking exclusivity from A+E for its content, opted not to renew its agreement with the company.


Brad Beale, Amazon’s director of digital video content acquisition, said that Amazon has more than doubled the amount of content for Amazon Prime customers.


“We remain focused on adding TV episodes and movies to Prime Instant Video that we think our customers will enjoy,” Beale said. “A+E Networks has some of the most popular shows on television and we know our customers will love streaming the A+E content with Prime Instant Video.”

Venezuela searches for fashion boss Missoni’s plane






CARACAS/MILAN (Reuters) – Venezuelan emergency services mounted a sea and air rescue mission on Saturday after a plane carrying fashion executive Vittorio Missoni went missing off the coast of Venezuela.


The plane carrying Missoni, 58, his wife, Maurizia Castiglioni, another couple and two Venezuelan crew members disappeared after taking off from the resort of Los Roques, an archipelago off the coast of Venezuela, Italian media said.






“It disappeared yesterday. They have been looking for it with helicopters and ships, but have not found anything yet. They are still searching for it this morning,” the Italian consul in Venezuela, Giovanni Davoli, told Reuters by phone.


Missoni is the oldest son of the founders of the fashion house famous for its exuberantly coloured knits, featuring bold stripes and zigzags. He is co-owner with siblings Luca and Angela, who handle the technical and design sides of the firm.


“The Missoni family has been informed by the Venezuelan consulate that Vittorio Missoni and his wife are missing, but we don’t know any more,” said Missoni spokeswoman Maddalena Aspes.


Other members of the Missoni family are travelling back to Italy from a holiday in France, Aspes said.


Missoni and his siblings took over managing the company from their parents Ottavio and Rosita in 1996, aiming to relaunch the brand to a larger, younger market as rivals Gucci and Burberry have done. Under Vittorio’s tenure, Missoni has opened hotels in Edinburgh and Kuwait and launched the Missoni Home collection.


By 2011, the brand’s appeal was wide enough for U.S. mass-market retailer Target to ask it to design a collection.


The brand will celebrate its 60th anniversary this year.

Scare Amplifies Fears That Clinton’s Work Has Taken Heavy Toll

WASHINGTON — When Secretary of State Hillary Rodham Clinton fractured her right elbow after slipping in a State Department garage in June 2009, she returned to work in just a few days. Her arm in a sling, she juggled speeches and a trip to India and Thailand with physical therapy, rebuilding a joint held together with wire and pins.




It was vivid evidence of Mrs. Clinton’s indomitable stamina and work ethic — as a first lady, senator, presidential candidate and, for the past four years, the most widely traveled secretary of state in American history.


But after a fall at home in December that caused a concussion, and a subsequent diagnosis of a blood clot in her head, it has taken much longer for Mrs. Clinton to bounce back. She was released from a hospital in New York on Wednesday, accompanied by her daughter, Chelsea, and her husband, former President Bill Clinton. On Thursday, she told colleagues that she hoped to be in the office next week.


Her health scare, though, has reinforced the concerns of friends and colleagues that the years of punishing work and travel have taken a heavy toll. Even among her peers at the highest levels of government, Mrs. Clinton, 65, is renowned for her grueling schedule. Over the past four years, she was on the road for 401 days and spent the equivalent of 87 full days on a plane, according to the State Department’s Web site.


In one 48-hour marathon in 2009 that her aides still talk about, she traveled from talks with Palestinian leaders in Abu Dhabi to a midnight meeting with Prime Minister Benjamin Netanyahu in Jerusalem, then boarded a plane for Morocco, staying up all night to work on other issues, before going straight to a meeting of Arab leaders the next morning.


“So many people who know her have urged me to tell her not to work so hard,” said Melanne S. Verveer, who was Mrs. Clinton’s chief of staff when she was first lady and is now the State Department’s ambassador at large for women’s issues. “Well, that’s not easy to do when you’re Hillary Clinton. She doesn’t spare herself.”


It is not just a matter of duty, Ms. Verveer and others said. Mrs. Clinton genuinely relishes the work, pursuing a brand of personal diplomacy that, she argues, requires her to travel to more places than her predecessors.


While there is no medical evidence that Mrs. Clinton’s clot was caused by her herculean work habits, her cascade of recent health problems, beginning with a stomach virus, has prompted those who know her best to say that she desperately needs a long rest. Her first order of business after leaving the State Department in the coming weeks, they say, should be to take care of herself.


Some even wonder whether this setback will — or should — temper the feverish speculation that she will make another run for the White House in 2016.


“I am amazed at the number of women who come up to me and tell me she must run for president,” said Ellen Chesler, a New York author and a friend of Mrs. Clinton’s. “But perhaps this episode will alter things a bit.”


Given Mrs. Clinton’s enduring status as a role model, Ms. Chesler said women would be watching which path she decides to take, as they plan their own transitions out of the working world.


“Do remember that women of our generation are really the first to have worked through the life cycle in large numbers,” she added. “Many seem to be approaching retirement with dread.”


For now, aides say, Mrs. Clinton’s focus is on wrapping up her work at the State Department. She would like to take part in a town hall-style meeting, thank her staff and sit for some interviews. But first she has to get clearance from her doctors, who are watching her to make sure that the blood thinners they have prescribed for her clot are working.


Speaking to a meeting of a foreign policy advisory board from her home in Chappaqua, N.Y., on Thursday, Mrs. Clinton said she was crossing her fingers and encouraging her doctors to let her return next week. “I’m trying to be a compliant patient,” she said, according to a person who was in the room. “But that does require a certain level of patience, which I’ve had to cultivate over the last three and a half weeks.”


While convalescing, Mrs. Clinton has spoken with President Obama and has held a 30-minute call with Senator John Kerry, Democrat of Massachusetts, whom Mr. Obama nominated as her successor.

Shares in Jewel parent soar on report of deal









Stock in Jewel-Osco parent Supervalu soared 13.5 percent Friday on speculation that the company is on the brink of a deal with Cerberus Capital Management.

Shares for the Eden Prairie, Minn-based grocery company closed at $2.94.

Supervalu spokesman Mike Siemienas said the company is in talks with several suitors, though a deal is not assured.  A representative for Cerberus Capital Management, a New York-based investment firm, declined to comment for this story.

The Eden Prarie, Minn-based company, which also owns Albertsons, Cub, Acme and Save-A-Lot stores, said it was exploring strategic alternatives, including a sale, in July. Days later, Supervalu dismissed CEO Craig Herkert, and Chairman Wayne Sales stepped in to run the troubled grocer.

Supervalu sales and earnings have lagged those of competitors for years. In 2012, the company's stock price fell 69.6 percent and return on investment declined 68.6 percent, according to Bloomberg. Average stock prices in the broader consumer staples market rose 7.4 percent and returns gained 10.7 percent in the period.

For the fiscal year ended Feb. 25, Supervalu reported a loss of $1.04 billion, which included a $519 million operating loss and $509 million in interest expense. Sales declined 3 percent, to $27.9 billion. The company has carried an onerous debt load since buying Albertsons, which included Chicago's Jewel-Osco chain, in 2006, making Supervalu the subject of bankruptcy  speculation.

Cerberus is rumored to be in the mix to buy parts of the company. The firm has experience in the food retail sector and was an investor in the 2006 Albertsons deal. Cerberus still holds a stake in Albertsons and Strategic Restaurants, a Burger King franchisee with more than 250 restaurants.

Among the myriad political parlor games at City Hall, one of the longest running is the annual speculation about whether Northwest Side Ald. Richard Mell will finally step down.
 
Mell, 74 and the second-longest serving alderman on the City Council, said today that he’s always thinking about retiring, and nodded to the boy-who-cries-wolf nature of his yearly decision.
 
“I’ve been retiring for the past five years,” said Mell, 33rd. “Sure, it’s tempting. I think it’s tempting for everybody (on the City Council).”
 
“This is premature,” Mell said of a report he was on his way out. “I haven’t made any decision, and I may not make a decision (to retire).”
 
The alderman, who chairs the powerful City Council Rules Committee, said he would like his daughter, State Rep. Deborah Mell, to succeed him when he does retire. Deborah Mell would do a good job on the council, her father said, adding he thinks she’s interested in the post.
 
The alderman, however, would not say whether he has told Mayor Rahm Emanuel he would like his daughter appointed to his seat if he decides to retire.
 
Adding to the confusion, The Civil Rights Agenda, a group that works for gay rights, sent out a notice applauding Deborah Mell’s imminent appointment as alderman. But Rick Garcia, political director for the organization, said they were basing their announcement on a Sun-Times report and said Deborah Mell had not confirmed the move.
 
Deborah Mell could not immediately be reached for comment.

Why Some Facebook Users Constantly Update Status






Scientists have found what compels people to constantly update their Facebook status. College students who posted more status updates than they normally did felt less lonely over the course of a week, even if no one “Liked” or commented on their posts, researchers found.


“We got the idea to conduct this study during a coffee-break sharing random stories about what friends had posted on Facebook,” psychology researcher Fenne große Deters, of the Universitat Berlin, told LiveScience in an email. “Wondering why posting status updates is so popular, we thought that it would be thrilling to study this new form of communication empirically.”






Deters and her colleague recruited about 100 undergraduates (all Facebook users) at the University of Arizona. All participants filled out initial surveys to measure their levels of loneliness, happiness and depression, and they gave the researchers access to their Facebook profiles by friending a dummy user created for the experiment.


The students were sent an analysis of their average weekly status updates (online wall-memos) and some of the participants were then told to post more statuses than usual over the next seven days. During that week, all completed a short online questionnaire at the end of each day about their mood and level of social connection.


Compared with the group of students who didn’t adjust their social media habits, those who went on a status-writing blitz felt less lonely over the week, the team found. Their happiness and depression levels went unchanged, “suggesting that the effect is specific to experienced loneliness,” the researchers wrote. And a drop in loneliness was linked to an increase in feeling more socially connected, which the researchers believe is the cause behind the positive effects of status updating. Interestingly, the team found that loneliness levels did not depend on whether the students’ status updates garnered any comments or “Likes” from Facebook friends. One might assume that a lack of response could be considered a form of rejection, but the act of writing a status update itself might help people feel more connected, the researchers said. When crafting a clever status, Facebook users have a target audience in mind. Simply thinking about their friends (or at least their Facebook friends) can have a “social snacking” effect.


“Similar to a snack temporarily reducing hunger until the next meal, social snacking may help tolerate the lack of ‘real’ social interaction for a certain amount of time,” the researchers wrote in a paper published last month in the journal Social Psychological and Personality Science.


Now with over a billion users, Facebook has become the focus of an increasing number of studies trying to uncover the real-life social side effects that can accompany using the social media site.


For example, research presented last year at the meeting of the Society for Personality and Social Psychology (SPSP) showed how the site offers a dangerous medium for social comparison. People in that study with lots of Facebook friends had lower self-esteem, feeling worse about their place in life and their achievements if they’d just viewed their friends’ status updates, compared with people who hadn’t recently surfed the site. But for people with just a few Facebook friends, viewing status updates wasn’t a problem.


Another study, detailed in the Sept. 13 issue of the journal Nature, found such Facebook friends can influence real-life actions of one another. In that study, one “get out the vote” message sent to 61 million Facebook users on Election Day 2010 led to 340,000 people casting ballots when they otherwise would not have.

Adele’s “21″ scores again, beating Swift for 2012′s top album






LOS ANGELES (Reuters) – British singer Adele‘s Grammy-winning “21″ scored a rare feat in 2012 as it topped U.S. album sales for a second straight year, beating out U.S. country-pop star Taylor Swift‘s “Red, Nielsen Soundscan said on Thursday.


It was the first time a single album had been a top-seller for two years in a row since Nielsen began tracking album sales in 1991, the organization said.






But U.S. album sales overall fell 4 percent in 2012 to 315.96 million albums, after 2011 saw a rare 3 percent bump in sales.


Adele’s “21″ sold 4.41 million units in the United States in 2012 to top Swift’s “Red,” which sold 3.11 million copies. In 2011, “21″ sold 5.82 million units.


“It’s a sort of a once-in-a-lifetime album,” Keith Caulfield, associate director of charts at Billboard, told Reuters of “21.” “Only a few of these albums come along in history.”


The heartbreak record, with hits like “Rolling in the Deep” and “Someone Like You,” earned Adele six Grammy Awards in early 2012, boosting the profile of the 24-year-old singer and songwriter, who records on indie label XL Recordings.


The album sold at a furious pace, reaching the 10 million albums-sold plateau in the span of two years, Caulfield noted. The last album to achieve that feat was boy band ‘N Sync’s “No Strings Attached,” which was released in 2000.


“It’s really the right combination of artistry and hit singles,” Caulfield said of “21′s” success.


“She really crossed over from pop to Latin to adult contemporary to dance,” he added. “Young and old consumers bought it, and because of its mixture of fans, she was able to sell it as well as she did.”


Adele’s success came despite the drop in 2012 U.S. album sales.


“Last year (2011) was a fluke,” Caulfield said. “A year gain in album sales is a mega achievement. … It’s the way the market works now, people buy songs and not albums.”


Indeed, digital song sales rose 5 percent in 2012 to a record high 1.336 billion downloads.


The year’s best-selling albums in the United States had a particularly British flavor as Swift was the lone American in the top five. Swift records for the independently owned Nashville-based Big Machine, distributed by Universal Music Group.


British boy band One Direction’s “Up All Night,” released in 2011 on Sony Music Entertainment’s SYCO/Columbia label, placed third with 1.62 million units sold, while their 2012 follow-up, “Take Me Home,” took the fifth spot with 1.34 million units sold.


Britain’s folk revivalists Mumford & Sons, on indie record label Glassnote, placed fourth with their album “Babel” selling 1.46 million units.

Scant Proof Is Found to Back Up Claims by Energy Drinks





Energy drinks are the fastest-growing part of the beverage industry, with sales in the United States reaching more than $10 billion in 2012 — more than Americans spent on iced tea or sports beverages like Gatorade.




Their rising popularity represents a generational shift in what people drink, and reflects a successful campaign to convince consumers, particularly teenagers, that the drinks provide a mental and physical edge.


The drinks are now under scrutiny by the Food and Drug Administration after reports of deaths and serious injuries that may be linked to their high caffeine levels. But however that review ends, one thing is clear, interviews with researchers and a review of scientific studies show: the energy drink industry is based on a brew of ingredients that, apart from caffeine, have little, if any benefit for consumers.


“If you had a cup of coffee you are going to affect metabolism in the same way,” said Dr. Robert W. Pettitt, an associate professor at Minnesota State University in Mankato, who has studied the drinks.


Energy drink companies have promoted their products not as caffeine-fueled concoctions but as specially engineered blends that provide something more. For example, producers claim that “Red Bull gives you wings,” that Rockstar Energy is “scientifically formulated” and Monster Energy is a “killer energy brew.” Representative Edward J. Markey of Massachusetts, a Democrat, has asked the government to investigate the industry’s marketing claims.


Promoting a message beyond caffeine has enabled the beverage makers to charge premium prices. A 16-ounce energy drink that sells for $2.99 a can contains about the same amount of caffeine as a tablet of NoDoz that costs 30 cents. Even Starbucks coffee is cheap by comparison; a 12-ounce cup that costs $1.85 has even more caffeine.


As with earlier elixirs, a dearth of evidence underlies such claims. Only a few human studies of energy drinks or the ingredients in them have been performed and they point to a similar conclusion, researchers say — that the beverages are mainly about caffeine.


Caffeine is called the world’s most widely used drug. A stimulant, it increases alertness, awareness and, if taken at the right time, improves athletic performance, studies show. Energy drink users feel its kick faster because the beverages are typically swallowed quickly or are sold as concentrates.


“These are caffeine delivery systems,” said Dr. Roland Griffiths, a researcher at Johns Hopkins University who has studied energy drinks. “They don’t want to say this is equivalent to a NoDoz because that is not a very sexy sales message.”


A scientist at the University of Wisconsin became puzzled as he researched an ingredient used in energy drinks like Red Bull, 5-Hour Energy and Monster Energy. The researcher, Dr. Craig A. Goodman, could not find any trials in humans of the additive, a substance with the tongue-twisting name of glucuronolactone that is related to glucose, a sugar. But Dr. Goodman, who had studied other energy drink ingredients, eventually found two 40-year-old studies from Japan that had examined it.


In the experiments, scientists injected large doses of the substance into laboratory rats. Afterward, the rats swam better. “I have no idea what it does in energy drinks,” Dr. Goodman said.


Energy drink manufacturers say it is their proprietary formulas, rather than specific ingredients, that provide users with physical and mental benefits. But that has not prevented them from implying otherwise.


Consider the case of taurine, an additive used in most energy products.


On its Web site, the producer of Red Bull, for example, states that “more than 2,500 reports have been published about taurine and its physiological effects,” including acting as a “detoxifying agent.” In addition, that company, Red Bull of Austria, points to a 2009 safety study by a European regulatory group that gave it a clean bill of health.


But Red Bull’s Web site does not mention reports by that same group, the European Food Safety Authority, which concluded that claims about the benefits in energy drinks lacked scientific support. Based on those findings, the European Commission has refused to approve claims that taurine helps maintain mental function and heart health and reduces muscle fatigue.


Taurine, an amino acidlike substance that got its name because it was first found in the bile of bulls, does play a role in bodily functions, and recent research suggests it might help prevent heart attacks in women with high cholesterol. However, most people get more than adequate amounts from foods like meat, experts said. And researchers added that those with heart problems who may need supplements would find far better sources than energy drinks.

U.S. unemployment holds at 7.8%

The pace of hiring by U.S. employers eased slightly in December, pointing to a lackluster pace of economic growth that was unable to make further inroads in the country's still high unemployment rate.

Payrolls outside the farming sector grew 155,000 last month, the Labor Department said on Friday. That was in line with analysts' expectations and slightly below the level for November.






Gains in employment were distributed broadly throughout the economy, from manufacturing and construction to health care.

That should reinforce expectations that the economy will grow about 2 percent this year, unlikely to quickly bring down the unemployment rate or make the U.S. Federal Reserve rethink its easy-money policies, which have been propping up the recovery.

"It's not a booming economy, but it is growing," Jim O'Sullivan, an economist at High Frequency Economics in Valhalla, New York, said before the data was released.

The jobless rate held steady at 7.8 percent in December, down nearly a percentage point from a year earlier but still well above the average rate over the last 60 years of about 6 percent.

The Labor Department raised its estimate for the unemployment rate in November by a tenth of a point to 7.8 percent, citing a slight change in the labor market's seasonal swings.

Most economists expect the U.S. economy will be held back by tax hikes this year as well as by weak spending by households and businesses, which are still trying to reduce their debt burdens.

Friday's data nonetheless gave signals of growing momentum in the labor market's recovery from the 2007-09 recession. Many economists had expected December's payroll gains to be padded by one-time factors like the recovery from a mammoth storm that hit the East Coast in late October.

The government had said last month the storm had no substantial impact on the November data, and many economists expected the government to recant by revising downward in Friday's report its estimate for payroll gains in November. Instead, the government revised its estimate for November payrolls upward by 15,000.

"There is some evidence that underlying jobs growth has improved," Paul Dales, an economist at Capital Economics in London, said before the report was released.

AUSTERITY'S BITE

Despite the signs of some momentum in hiring, a wave of government spending cuts due to begin around March loom over the economy.

Many economic forecasts assume the cuts - which would hit the military, education and other areas - will ultimately be pushed into next year as part of a deal sought by lawmakers to reduce gradually the government's debt burden.

Initially, the cuts were planned to have begun this month as part of a $600 billion austerity package that also included tax hikes. Hiring in December may have been slowed by uncertainty over the timing of the austerity, economists say.

Congress this week passed legislation to avoid most of the tax hikes and postpone the spending cuts.

Even with the last-minute deal to avoid much of the "fiscal cliff," most workers will see their take-home pay reduced this month as a two-year cut in payroll taxes expires.

That leaves the Fed's efforts to lower borrowing costs as the main program for stimulating the economy.

The Fed has kept interest rates near zero since 2008, and in September promised open-ended bond purchases to support lending further. On Thursday, however, minutes from the Fed's December policy review pointed to rising concerns over how the asset purchases will affect financial markets.

Analysts ahead of the report expected some of the strength in job creation in December would be due to the Fed's policies.

"Despite the end-of-year angst over the ‘fiscal cliff,' financial conditions remained supportive of job growth in December," economists at Nomura said in a note to clients earlier in the week.

The Most and Least Influential Social Media Celebs






While he isn’t currently available for promotional work, businesses would have the most success on social media with President Barack Obama endorsing their goods and services, new research shows.


A study by social marketing platform SocialToaster revealed that Obama is considered the most influential celebrity on social media. Justin Bieber, Lady Gaga, Ashton Kutcher and Anderson Cooper followed the president on the rankings of social influencers.






On the flip side, the research found that former Republican presidential nominee Mitt Romney was the least influential celebrity on social media, finishing just below Madonna, Kanye West and Sean Hannity.


While celebrities might be influential on social media in some aspects, it’s those closest to us who make the largest impact when it comes to the important issues. Nearly all of the social media users surveyed agreed that a social media post from a close friend or family member was most likely to influence them on important subjects, with politicians and athletes the least likely to influence them.


“While it was no surprise that in this election year Barack Obama would be ranked the most influential person in social media, it was surprising to us that Justin Bieber and Lady Gaga would beat Madonna and Kanye West,” said Brian Razzaque, CEO of SocialToaster. “We were also surprised to see that friends had more pull than family when it came to influencing the sharing of social media content.”


Regardless of whom it comes from, there are some posts that will quickly result in an unfollowing, the study discovered. Nearly three-quarters of those surveyed said a racist post would cause them to immediately unfollow someone on social media. Other types of posts that result in a loss of followers include sexism, pornography, repetitive, overly personal posts and those that use poor grammar.


The researcher was based on surveys of 3,000 SocialToaster Super Fans, which consist of social media experts and professionals, many of whom work with some of the nation’s leading brands. The experts range from those who work in the entertainment industry who represent numerous television shows and movies to those who work in professional sports, including the Baltimore Ravens and the Detroit Pistons.

“Hunger Games” and “Hobbit” most-anticipated films of 2013: poll






LOS ANGELES (Reuters) – This year will look a lot like 2012 at the box office, with “The Hunger Games” and Hobbits at the top of cinemagoers must-see lists, according to a survey by ticket-seller Fandango released on Thursday.


The second installment in “The Hunger Games” trilogy, “The Hunger Games: Catching Fire,” which is set for a November release, topped the list as 2013′s most-anticipated blockbuster.






The first film in the life-or-death thriller series starring Jennifer Lawrence, raked in some $ 687 million at the worldwide box office in 2012.


The Hobbit: The Desolation of Smaug,” director Peter Jackson‘s second installment in the “The Hobbit” series of elves and dwarves, ranked second on the survey that polled more than 2,000 moviegoers during the final week of 2012. It is scheduled to hit the big screen in December.


“People love the mega-franchises and that is what gets them most excited,” Dave Karger, Fandango chief correspondent, told Reuters. “The first ‘Hunger Games‘ whetted peoples’ appetites for more. The same can be said for ‘The Hobbit‘ and ‘Iron Man.’”


The superhero thriller “Iron Man 3″ starring Robert Downey Jr. ranked third on the list and is set for a May 3 release.


“Star Trek into Darkness” – the follow-up to 2009′s “Star Trek” science-fiction adventure – and “The Great Gatsby” starring Leonardo DiCaprio rounded out the top five. Both films are set to open in May.


‘JAZZED’ ABOUT FRANCHISES


The heavy dose of franchise films on the list indicates how familiarity can build buzz among moviegoers, Karger said.


“In the case of ‘The Hunger Games,’ many people who loved the movie have read the other books so they’re excited to see it brought to life,” he said. “The same with ‘The Hobbit‘ too.


“Some people say, ‘Where is the originality?’ but the fact of the matter is that these franchises are what people get most jazzed about.”


The survey also asked film fans to vote on the sexiest man and woman on the big screen in 2013, as well as best villain, breakout stars and best apocalyptic films.


Mila Kunis, who stars in upcoming film “Oz: The Great and Powerful,” was voted sexiest actress, while Channing Tatum was voted sexiest man for Paramount’s “G.I. Joe: Retaliation.” Both films are set for March releases.


Ben Kingsley (“Iron Man 3″) was voted most-anticipated villain, and June’s zombie thriller “World War Z” starring Brad Pitt was voted most-anticipated apocalyptic film.


British actress Alice Eve was voted biggest breakout actress for “Star Trek” while fellow Brit Henry Cavill got the nod as biggest breakout actor for playing Superman opposite Russell Crowe and Amy Adams in “Man of Steel,” which will be released in June.

5-Hour Energy’s ‘No Crash Later’ Claim Is Disputed





The distributor of the top-selling energy “shot,” 5-Hour Energy, has long claimed on product labels, in promotions and in television advertisements that the concentrated caffeine drink produced “no crash later” — the type of letdown that consumers of energy drinks often feel when the beverages’ effects wear off.




But an advertising watchdog group said on Wednesday that it had told the company five years ago that the claim was unfounded and had urged it then to stop making it.


An executive of the group, the National Advertising Division, also said that 5-Hour Energy’s distributor, Living Essentials, had publicly misrepresented the organization’s position about the claim and that it planned to start a review that could lead to action against the company by the Federal Trade Commission.


“We recommended that the ‘no crash’ claim be discontinued because their own evidence showed there was a crash from the product,” said Andrea C. Levine, director the National Advertising Division. The organization, which is affiliated with the Council of Better Business Bureaus, reviews ad claims for accuracy.


The emerging dispute between Living Essentials and the National Advertising Division is unusual because the $10 billion energy drink industry is rife with questionable marketing. And Living Essentials, which recently cited the advertising group’s support in seeking to defend the “no crash” claim, may have opened the door to greater scrutiny.


Major producers like 5-Hour Energy, Red Bull, Monster Energy and Rockstar Energy all say their products contain proprietary blends of ingredients that provide a range of mental and physical benefits. But the companies have conducted few studies to show that the costly products provide anything more than a blast of caffeine, a stimulant found in beverages like coffee, tea or cola-flavored sodas.


The dispute over 5-Hour Energy’s claim also comes as regulatory review of the high-caffeine drinks is increasing. The Food and Drug Administration recently disclosed that it had received reports over the last four years citing the possible role of 5-Hour Energy in 13 deaths. The mention of a product in an F.D.A. report does not mean it caused a death or injury. Living Essentials says it knows of no problems related to its products.


The issue surrounding the company’s “no crash” claim dates to 2007, when National Advertising Division began reviewing all of 5-Hour Energy’s marketing claims. That same year, the company conducted a clinical trial of the energy shot that compared it to Red Bull and Monster Energy.


At the time, Living Essentials was already using the “No crash later” claim. An article on Wednesday in The New York Times reported that the study had shown that 24 percent of those who used 5-Hour Energy suffered a “moderately severe” crash hours after consuming it. The study reported higher crash rates for Red Bull and Monster Energy.


When asked how those findings squared with the company’s “no crash” claim, Elaine Lutz, a spokeswoman for Living Essentials, said the company had amended the claim after the 2007 review by the National Advertising Division. In doing so, it added an asterisklike mark after the claim on product labels and in promotions. The mark referred to additional labeling language stating that “no crash means no sugar crash.” Unlike Red Bull and Monster Energy, 5-Hour Energy does not contain sugar.


Ms. Lutz said that based on the modification, the advertising accuracy group “found all of our claims to be substantiated.”


However, Ms. Levine, the advertising group’s director, took sharp exception to that assertion, saying it mischaracterized the group’s decision. And a review of the reports suggested that Living Essentials had simply added language of its choosing to its label rather than doing what the group had recommended — drop the “no crash” claim altogether.


That review concluded that the company’s 2007 study had shown there was evidence to support a “qualified claim that 5-Hour Energy results in less of a crash than Red Bull and Monster” Energy. But it added the study, which showed that 5-Hour Energy users experienced caffeine-related crashes, was inadequate to support a “no crash” claim.


Ms. Levine said Living Essentials had apparently decided to use the parts of the group’s report that it liked and ignore others.


Companies “are not permitted to mischaracterize our decisions or misuse them for commercial purposes,” she said.


She said the group planned to notify Living Essentials that it was reopening its review of the “no crash later” claim. If the company fails to respond or provides an inadequate response, the National Advertising Division will probably refer the matter to the F.T.C., she said.


A Democratic lawmaker, Representative Edward Markey of Massachusetts, has asked that the agency review energy drink marketing claims.


Asked about the position of the National Advertising Division, Ms. Lutz, the 5-Hour Energy spokeswoman, stated in an e-mail that the “no sugar crash” language had been added to address the group’s concern.

Net worth of world's richest rose by $241B in 2012









The richest people on the planet got richer in 2012, adding $241 billion to their collective net worth, according to the Bloomberg Billionaires Index, a daily ranking of the world's 100 wealthiest individuals.

The aggregate net worth of the world's top moguls stood at $1.9 trillion at the market close on Dec. 31, according to the index. Retail and telecommunications fortunes surged about 20 percent on average during the year. Of the 100 people who appeared on the final ranking of 2012, only 16 registered a net loss for the 12-month period.

"Last year was a great one for the world's billionaires," said John Catsimatidis, the billionaire owner of Red Apple Group, in an e-mail written poolside on his BlackBerry in the Bahamas. "In -- that will give them an advantage."

Amancio Ortega, the Spaniard who founded retailer Inditex SA, was the year's biggest gainer. The 76-year-old tycoon's fortune increased $22.2 billion to $57.5 billion, according to the index, as shares of Inditex, operator of the Zara clothing chain, rose 66.7 percent.

"It's an amazing company that has done great and the gains are quite justified given its performance," said Christodoulos Chaviaras, an analyst at Barclays Plc in London who has had an "equalweight" rating on Inditex for about a year. "Can they repeat that? It will be harder. A lot of the positive news is already reflected in the share price."

Global stocks soared in 2012. The MSCI World Index gained 13.2 percent during the year to close at 1,338.50 on Dec. 31. The Standard and Poor's 500 Index rose 13.4 percent to close at 1,426.19.

European stocks surged in the second half of the year. The Stoxx Europe 600 is up 19.6 percent since June 4, advancing as the European Central Bank introduced bond-buying programs, S&P upgraded Greece's debt and German business confidence rose more than forecast. The benchmark gauge's 14.4 percent advance for the year was the best annual return since 2009.

Carlos Slim, the telecommunications magnate who controls Mexico's America Movil SAB, remained the richest person on Earth for the year. The 72-year-old's net worth rose $13.4 billion -- or 21.6 percent -- through Dec. 31, making him the second-biggest gainer by dollars.

Gains by Slim's industrial conglomerate, Grupo Carso, and Grupo Financiero Inbursa, his banking and insurance operation, more than offset the decline posted by America Movil, his biggest holding. The largest mobile phone operator in the Americas by subscribers fell 5.8 percent to close at 14.9 pesos at the end of the year.

"America Movil is no longer the growth story that it has been, given the increase in Latin American wireless penetration over the last five years," said Chris King, an analyst at Stifel Nicolaus & Co. in Baltimore, Md. "It continues to generate a very high amount of cash flow and has the best set of telecom assets across Latin America."

According to King, one of Slim's biggest challenges will be dealing with regulation in Mexico and Colombia designed to punish or even-out the market share between America Movil and its competitors. Of the 14 analysts who cover the stock, 71 percent have a buy rating on the company, with an average target price of 19.15 pesos per share, according to data compiled by Bloomberg.

U.S. software mogul Bill Gates, 57, ranks second on the list, trailing Slim by $12.5 billion. The Microsoft co-founder added $7 billion to his net worth as shares of the Redmond, Wash.-based company rose 2.9 percent. Microsoft stock accounts for less than 20 percent of the billionaire's fortune.

Warren Buffett, 82, lost his title as the world's third- richest man to Ortega Aug. 6. The Berkshire Hathaway chairman gained $5.1 billion during the year, even after donating 22.3 million Berkshire Class B shares in July to charity. The billionaire, who has pledged to give away most of his fortune, spent much of the year pressing for higher taxes on the wealthy.

"On incomes of over $1 million, the excess $1 million should have a minimum tax of 30 percent. And then over $10 million, 35 percent," Buffett said in an interview with Charlie Rose in November. "Tax law should be progressive. And I think that when people make $15 million or $20 million or $200 million and pay a 10 percent rate, something should be done about it."

IKEA founder Ingvar Kamprad, 86, is the world's fifth- richest person with a $42.9 billion fortune. The complex ownership structure behind IKEA, the world's largest furniture retailer, became more transparent in August after IKEA's franchisor published its financial performance publicly for the first time. His net worth rose 16.6 percent in 2012.

Brazil's Eike Batista, 56, was the year's biggest loser by dollars, falling $10.1 billion. The commodities maven, who vowed a year ago that he'd become the world's wealthiest man by 2015, sold a 5.63 percent stake in his EBX Group in March to Abu Dhabi's Mubadala Development.

As part of the deal, he pledged an unspecified additional stake in 2019 if he fails to meet a 5 percent annual return on the sovereign wealth fund's $2 billion investment, according to a person with knowledge of the deal. Batista now ranks 75th in the world with a $12.4 billion net worth. On March 27, he was worth $34.5 billion and ranked 8th on the Bloomberg index.

"Next year is going to be a lot of work for Eike," said Lucas Brendler, who helps manage about 6 billion reais at Banco Geracao Futuro de Investimentos in Porto Alegre, Brazil. "It's going to be a year for him to recover investors' confidence, and to leave the realm of theory and start delivering results. The EBX companies have great growth potential."

Batista's former title as the richest Brazilian is now held by 73-year-old banker Jorge Paulo Lemann, who ranks 37th with an $18.8 billion fortune. The country's second-richest person is Dirce Camargo, the matriarch behind Camargo Correa SA, the Sao Paulo-based conglomerate that has interests in cement, electricity and Havaianas flip-flops. Her net worth is $13.4 billion, according to the Bloomberg ranking.

Taxes to rise for most Americans despite 'fiscal cliff' deal












President Barack Obama and congressional Republicans looked ahead today toward the next round of even bigger budget fights after reaching a hard-fought "fiscal cliff" deal that narrowly averted potentially devastating tax hikes and spending cuts.


The agreement, approved late on Tuesday by the Republican-led House of Representatives after a bitter political struggle, was a victory for Obama, who had won re-election on a promise to address budget woes in part by raising taxes on the wealthiest Americans.











But it set up political showdowns over the next two months on spending cuts and on raising the nation's limit on borrowing. Republicans, angry the deal did little to curb the federal deficit, promised to use the debt ceiling debate to win deep spending cuts next time.


Republicans, who acknowledged they had lost the fiscal cliff fight by agreeing to raise taxes on the wealthy without gaining much in return, vowed the next deal would have to include significant cuts in government benefit programs like Medicare and Medicaid health care for retirees and the poor that were the biggest drivers of federal debt.


"This is going to be much uglier to me than the tax issue … this is going to be about entitlement reform," Republican Senator Bob Corker of Tennessee said on CNBC.


Obama urged "a little less drama" when the Congress and White House next address thorny fiscal issues like the government's rapidly mounting $16 trillion debt load.


While the tax package that Congress passed will protect 99 percent of Americans from an income tax increase, most of them will still end up paying more federal taxes in 2013.


That's because the legislation did nothing to prevent a temporary reduction in the Social Security payroll tax from expiring. In 2012, that 2-percentage-point cut in the payroll tax was worth about $1,000 to a worker making $50,000 a year.


The Tax Policy Center, a nonpartisan Washington research group, estimates that 77 percent of American households will face higher federal taxes in 2013 under the agreement negotiated between President Barack Obama and Senate Republicans. High-income families will feel the biggest tax increases, but many middle- and low-income families will pay higher taxes too.


Households making between $40,000 and $50,000 will face an average tax increase of $579 in 2013, according to the Tax Policy Center's analysis. Households making between $50,000 and $75,000 will face an average tax increase of $822.


"For most people, it's just the payroll tax," said Roberton Williams, a senior fellow at the Tax Policy Center.


The tax increases could be a lot higher. A huge package of tax cuts first enacted under President George W. Bush was scheduled to expire Tuesday as part of the "fiscal cliff." The Bush-era tax cuts lowered taxes for families at every income level, reduced investment taxes and the estate tax, and enhanced a number of tax credits, including a $1,000-per-child credit.


The package passed Tuesday by the Senate and House extends most the Bush-era tax cuts for individuals making less than $400,000 and married couples making less than $450,000.


Obama said the deal "protects 98 percent of Americans and 97 percent of small business owners from a middle-class tax hike. While neither Democrats nor Republicans got everything they wanted, this agreement is the right thing to do for our country."


The income threshold covers more than 99 percent of all households, exceeding Obama's claim, according to the Tax Policy Center. However, the increase in payroll taxes will hit nearly every wage earner.


Social Security is financed by a 12.4 percent tax on wages up to $113,700, with employers paying half and workers paying the other half. Obama and Congress reduced the share paid by workers from 6.2 percent to 4.2 percent for 2011 and 2012, saving a typical family about $1,000 a year.


Obama pushed hard to enact the payroll tax cut for 2011 and to extend it through 2012. But it was never fully embraced by either party, and this time around, there was general agreement to let it expire.


The new tax package would increase the income tax rate from 35 percent to 39.6 percent on income above $400,000 for individuals and $450,000 for married couples. Investment taxes would increase for people who fall in the new top tax bracket.


High-income families will also pay higher taxes this year as part of Obama's 2010 health care law. As part of that law, a new 3.8 percent tax is being imposed on investment income for individuals making more than $200,000 a year and couples making more than $250,000.


Together, the new tax package and Obama's health care law will produce significant tax increases for many high-income families.

Apple‘s iPhone 5 bears the identifiers “iPhone 5.1″ and “iPhone 5.2″ and is powered by iOS 6 operating system.


Developer logs show that the app requests originate from an internet address on Apple’s Cupertino campus, suggesting that Apple engineers are testing compatibility for some of the popular apps, the website said.


“Although OS and device data can be faked, the unique IP footprint leading back to Apple’s Cupertino campus leads us to believe this is not one of those attempts,” the website said.


Apple launched iPhone 5 in September and it has been reported that the new iPhone will be released in the middle of 2013.

Jon Stewart to host Grammy’s MusiCares tribute






LOS ANGELES (AP) — Jon Stewart is hosting the MusiCares salute to Bruce Springsteen.


The Recording Academy also announced Wednesday that Elton John, Neil Young, Mumford & Sons, Sting, Mavis Staples and Kenny Chesney will be among more than a dozen performers who will help pay tribute to Springsteen during the Feb. 8 benefit concert, held in Los Angeles two days before the Grammy Awards.






Springsteen is MusiCare’s person of the year, an award given to a performer who is notable both artistically and philanthropically. The sold-out concert will benefit MusiCare’s emergency financial assistance and addiction recovery programs.


Other performers scheduled to appear include Juanes, Tim McGraw and Faith Hill, Jackson Browne and Alabama Shakes.


Stewart is the host of Comedy Central’s “The Daily Show With Jon Stewart.”

Safed Journal: New Insights on Marijuana in Israel, Where It’s Illegal

Tikkun Olam, a medical marijuana farm in Israel, blends the high-tech and the spiritual.







SAFED, Israel — Among the rows of plants growing at a government-approved medical marijuana farm in the Galilee hills in northern Israel, one strain is said to have the strongest psychoactive effect of any cannabis in the world. Another, rich in anti-inflammatory properties, will not get you high at all.




Marijuana is illegal in Israel, but farms like this one, at a secret location near the city of Safed, are at the cutting edge of the debate on the legality, benefits and risks of medicinal cannabis. Its staff members wear white lab coats, its growing facilities are fitted with state-of-the-art equipment for controlling light and humidity, and its grounds are protected by security cameras and guards.


But in addition to the high-tech atmosphere, there is a spiritual one. The plantation, Israel’s largest and most established medical marijuana farm — and now a thriving commercial enterprise — is imbued with a higher sense of purpose, reflected by the aura of Safed, an age-old center of Jewish mysticism, as well as by its name, Tikkun Olam, a reference to the Jewish concept of repairing or healing the world.


There is an on-site synagogue in a trailer, a sweet aroma of freshly harvested cannabis that infuses the atmosphere and, halfway up a wooded hillside overlooking the farm, a blue-domed tomb of a rabbinic sage and his wife.


In the United States, medical marijuana programs exist in 18 states but remain illegal under federal law. In Israel, the law defines marijuana as an illegal and dangerous drug, and there is still no legislation regulating its use for medicinal purposes.


Yet Israel’s Ministry of Health issues special licenses that allow thousands of patients to receive medical marijuana, and some government officials are now promoting the country’s advances in the field as an example of its pioneering and innovation.


“I hope we will overcome the legal obstacles for Tikkun Olam and other companies,” Yuli Edelstein, the minister of public diplomacy and diaspora affairs, told journalists during a recent government-sponsored tour of the farm, part of Israel’s effort to brand itself as something beyond a conflict zone. In addition to helping the sick, he said, the effort “could be helpful for explaining what we are about in this country.”


Israelis have been at the vanguard of research into the medicinal properties of cannabis for decades.


In the 1960s, Prof. Raphael Mechoulam and his colleague Yechiel Gaoni at the Weizmann Institute of Science isolated, analyzed and synthesized the main psychoactive ingredient in the cannabis plant, tetrahydrocannabinol, or THC. Later, Professor Mechoulam deciphered the cannabinoids native to the brain. Ruth Gallily, a professor emerita of immunology at the Hebrew University of Jerusalem, has studied another main constituent of cannabis — cannabidiol, or CBD — considered a powerful anti-inflammatory and anti-anxiety agent.


When Zach Klein, a former filmmaker, made a documentary on medical marijuana that was broadcast on Israeli television in 2009, about 400 Israelis were licensed to receive the substance. Today, the number has risen to about 11,000.


Mr. Klein became devoted to the subject and went to work for Tikkun Olam in research and development. “Cannabis was used as medicine for centuries,” he said. “Now science is telling us how it works.”


Israeli researchers say cannabis can be beneficial for a variety of illnesses and conditions, from helping cancer patients relieve pain and ease loss of appetite to improving the quality of life for people with post-traumatic stress disorder and neuropsychological conditions. The natural ingredients in the plant, they say, can help with digestive function, infections and recovery after a heart attack.


The marijuana harvest, from plants that can grow over six feet tall, is processed into bags of flowers and ready-rolled cigarettes. There are also cannabis-laced cakes, cookies, candy, gum, honey, ointments and oil drops. The strain known as Eran Almog, which has the highest concentration of THC, is recommended for severe pain. Avidekel, a strain rich in CBD and with hardly any psychoactive ingredient, allows patients to benefit from the drug while being able to drive and to function at work.


Working with Hebrew University researchers, the farm has also developed a version in capsule form, which would make exporting the drug more practical, should the law allow it.

Dow soars 2% after deal to avoid 'cliff'










NEW YORK (Reuters) - Stocks surged on the first trading day of 2013 after lawmakers agreed a deal to avoid massive tax hikes and spending cuts that had threatened to hurt economic growth.

The gains come after stocks ended 2012 with their strongest day in more than a month, which put the S&P 500 up 13.4 percent for the year, after a flat performance in 2011.

Late on Tuesday, the House of Representatives voted for a bill that will raise taxes on wealthy individuals and families and preserve certain benefits.

The vote averted immediate austerity measures, like tax hikes for almost all U.S. households, although it didn't resolve other political showdowns on the budget due in coming months. Spending cuts of $109 billion in military and domestic programs were only delayed for two months.

"Many investors are feeling confident heading into 2013 following a year of strong equity market returns, and the recently signed deal," said Jonathan Golub, strategist at UBS in New York.

"Unfortunately, our sense is that the most important structural issues will continue to be pushed off into the future, leaving significant uncertainty about the long-term direction of the economy and corporate profits."

The Dow Jones industrial average was up 255.72 points, or 1.95 percent, at 13,359.86. The Standard & Poor's 500 Index was up 28.75 points, or 2.02 percent, at 1,454.94. The Nasdaq Composite Index was up 75.18 points, or 2.49 percent, at 3,094.70.

Bank shares rose following news that U.S. regulators are close to securing another multibillion-dollar settlement with the largest banks to resolve allegations that they unlawfully cut corners when foreclosing on delinquent borrowers.

Bank of America Corp rose 4 percent to $12.06 and Wells Fargo shares added 2.4 percent to $35. JPMorgan Chase & Co shares rose 3 percent to $44.96.

Boosting the technology sector, Apple shares rose on a report that the most valuable technology company has started testing a new iPhone and the next version of its iOS software.The stock was up 3.9 percent at $552.86.

Shares of Zipcar Inc jumped 48 percent to $12.21 after Avis Budget Group Inc said it would buy Zipcar for about $500 million in cash to compete with larger rivals Hertz and Enterprise Holdings Inc.

On the macroeconomic front, U.S. manufacturing expanded slightly in December, rebounding from an unexpected contraction the prior month, an industry report showed on Wednesday.

A separate report showed U.S. construction spending fell in November for the first time in eight months, as an extended bout of weakness in the business sector outweighed modest growth in outlays on residential projects. The equity market's reaction to both reports was muted.

On the last day of trading in 2012, the Dow Jones industrial average gained 166.03 points, or 1.28 percent, to close at 13,104.14. The Standard & Poor's 500 Index gained 23.76 points, or 1.69 percent, to finish at 1,426.19. The Nasdaq Composite Index gained 59.20 points, or 2.00 percent, to close at 3,019.51.

In 2012, the Dow advanced 7.3 percent, while the Nasdaq climbed 15.9 percent.

Bears general manager: 'We need to consistently be in the playoffs'









A day after the Chicago Bears fired head coach Lovie Smith, general manager Phil Emery explained his decision to the media at Halas Hall.

As soon as the news conference was over, Emery was expected to kick the search for Smith’s replacement into high gear.

"It was a tough day in many ways," Emery said of Smith's firing Monday. "It was a tough decision. Lovie had a good run here with good, competitive teams."

Emery said the firing wasn't totally decided until Monday morning when he sat down and told Smith directly. He said missing the playoffs for the fifth time in six years and the team's struggles on offense were the key factors in his decision.

"The end result was we didn't have enough consistecy," Emery said. "We need to consistently be in the playoffs competing for championships.

"We haven't had the balance, we have not had consistency on the offensive side of the ball. We have gone through a number of coordinators."

Emery said he discussed his decision with team chairman George McCaskey and president Ted Phillips but was given the authority to make the call.

Emery said he will handle the initial coaching interviews by himself and that McCaskey and Phillips will be involved on finalists' interviews. Emery said he would be looking at all levels -- former head coaches, current coordinators, college coaches -- for potential candidates. He said being an NFL head coach was a "24/7 job."

"I want somebody with high energy," Emery said. "Someone who pulls together everyone in the building."

Emery said working well with the media and presenting a good public image also were important factors.

"I want this person to stand up and represent us well," he said.

Emery said he would conduct the search "with a sense of urgency," but "we have to be thorough."

He said "the (ongoing) playoffs are a consideration ... there may be a candidate who is in the playoffs and we may have to wait on that."

Emery said money was not a consideration in firing Smith with a year left on his deal and won't be in deciding on candidates, declining to rule out big-name hires.

"We want to win now," Emery said. "We want that championship now."

Emery said he wants an adaptable coach who can find ways to win with the players on hand, speaking both of quarterback Jay Cutler and also about the defense in terms of using a 4-3 or a 3-4 scheme.

"It's real important to find the person to make things fit with the players we have," Emery said.

Emery said he considered Cutler a "franchise quarterback" that the team needs to "build around," but as to whether he is the long-term solution, he said, "That answer is going to come as we move forward with the new head coach."

"Jay has won a lot of games," Emery said. "We need to build around him."
